Hungarian Constitutional Court: Foreign same-sex marriages must be recognized as registered partnerships

On June 3, the Hungarian Constitutional Court found that it is an unconstitutional omission that Hungarian law does not ensure the domestic recognition of same-sex marriages concluded abroad as registered partnerships. The Court called on the Parliament to fulfill its legislative duty by October 31, 2025.

Pécs Pride will take place even if the Kúria says it is not possible to stand up for our rights

The Kúria (Supreme Court of Hungary) today upheld the police's ban on Pécs Pride – according to Hungary’s supreme court, the following things cannot be done in public spaces in Hungary:

  • stand up for equal rights for sexual and gender minorities
  • protest against arbitrary restrictions on freedom of assembly
  • commemorate gay, lesbian, bisexual and transgender people murdered during the Holocaust
  • speak out against the exclusion of Roma under the pretext of "protecting local identity".

According to the judgment rendered by the CJEU today, the GDPR obliges Hungarian authorities to correct personal data on gender identity where it is inaccurate, i.e. in all cases where the social reality and gender identity of trans people differs from their sex at birth. The absence of a procedure for legal gender recognition does not exempt Hungary from its obligations under EU law.

The Fifteenth amendment to the "granite-solid" Fundamental Law has arrived, further oppressing transgender people in Hungary. If their daily lives weren't hard enough, with another amendment Fidesz politicians would remove protection from discrimination and harassment based on gender identity from the Equal Treatment Act.
